Belgium Nationality 2025

Hodaya Biske

@maharaji1984

Who will Apostille the translation? The translation is done by the Sworn translator in Belgium.

@Hodaya Biske

You definitely need to translate it. I am not sure about apostile though. But it would be safer if you do it.

No need for appostile.

The apostille should be on the document itself. For sworn translation - the translator ties document and translation and puts his stamp, that is enough.

Has anyone requested nationality in Brussels 1000? I would like to hear about your experience.

I emailed the commune 4 months after receiving the acknowledgment of reception of the complete file, citing that according to the law (article 15, 搂3 du Code de la nationalit茅 belge), the prosecutor has 4 months from the date of the acknowledgment to give a decision.

They replied saying that the whole procedure takes 6 months. I'm not sure if taking two months extra is reasonable or if it can be considered a denial of my rights.

Your understanding of Article 15, 搂3 of the Belgian Nationality Code is correct: the prosecutor has 4 months from the acknowledgment of receipt (accus茅 de r茅ception du dossier complet) to issue an opinion. If no opposition is made within those 4 months, the nationality declaration is automatically acquired by law,聽 the prosecutor can鈥檛 intervene afterward.

In practice, communes sometimes mention 鈥6 months鈥 because of their internal administrative processing time but that doesn鈥檛 extend the legal period.

After the 4 months have passed without opposition, your nationality should legally be considered granted, and any further delay is administrative, not legal.

Hi everyone,

When I applied for Belgian nationality I submitted a legalized, translated copy of my birth certificate. I also showed the original, which the town hall took. This original is a replacement and cannot be reissued.

Will they return it after the nationality process is finished? Has anyone experienced this?

RKE09

@Smlg,

Commune with return the documents. When you receive a letter granting Belgium Nationality, there will be one more letter asking you to collect your original documents.

Smlg

@RKE09

thanks 馃槉

I鈥檓 really frustrated because they took the original too. I didn鈥檛 notice at the time, and now I urgently need it but have no idea how to sort it out.

@Smlg

My original documents taken and never given back.

@maharaji1984

Did you actually give them your original birth certificate?

I checked with my town hall, and they told me that:

聽 聽 鈥⒙ 聽 If my nationality gets approved, they鈥檒l make a Belgian copy of my birth certificate in the DABS system, and I鈥檒l be able to pick it up.

聽 聽 鈥⒙ 聽 If it鈥檚 rejected, I can either accept the decision or ask for the file to be sent to court.

If I accept, I can get my birth certificate back from the commune. But if it goes to court, all the documents 鈥 including the birth certificate 鈥 have to stay in the file.

Every time I have given an original I wait for them to take a copy and give it back to me, If I have to send it in the mail, I make a copy myself.

Never had an issue.

@Smlg

Yes they took birth certificate. Other documents given back (Payslips , compte induviduele, language certificates,)

I think IBZ doesn't issue for you a Belgian Birth Certificate as you was not born in Belgium. But just a Nationality certificate.

Jeconr

@maharaji1984

I have a Belgian birth certificate even though I was not born in Belgium.

I had to provide my foreign birth certificate to my commune to correct a mistake my name in the Belgian national registry. The commune produced a Belgian birth certificate during this process. I don't know if this is typical or the commune gave me a nice byproduct smile.png.
