How quickly did you get your residency after marriage?

Hi there,


I'm American, marrying a Brazilian. I'm waiting for my fingerprints and then I'll apply for residency/citizenship. I need to travel back to California but I overstayed my visa by 6 months! I can't leave and return until I get my Brazilian residency.


We are officially getting married March 26, 2024. How long after that can I expect to get residency. I should have my fingerprints by then.

I would guess 3 months. I recieved mine during the beginning of COVID. also the change of administration.  hopefully, someone who processed recently can give more accurate info. But you can also talk to Br immigration.

02/26/24 @Andrewsoluna.  Welcome, Andrew!  I'm assuming from what you've written that your plan is to continue overstaying your visa until May, and getting married here in Brazil.  Do I have that right, or have I misunderstood?


*ETA*  When you write "waiting for your fingerprints", do you mean that you're waiting for your FBI Background Check from the US?

@Andrewsoluna Well you came to the right place, but i am confused as to where you are during certain steps. Are you in Canada getting your background check and fingerprints? That would be the way to go. Where are you when you get married? If you are in Canada, book a stop at the Brazilian Consulate while you are there, if it works like it does in the USA.

I overstayed my visa by six months


Ha, 6 months is for wimps, I was going on a year.  Seriously I paid a fine of R$ 7,250 and now I am on my 60-day tour to get the correct documentation.


Note of advice.  Double check the application form with your lawyer. We initially were going that route before we realized my wife had used more than one name on her official documentation in the past. She was also previously married (this is not a dealbreaker, but they are going to want documents which may not still be available)


Also remember 3 months turnaround time is an estimate. As my friend @alan279 will tell you if anything can go wrong, well....
