Hi Concon and Joejoe,

your Rights are through the Freedom of Movement Act within the EU which actually implies 'movement' to another EU contry. Otherwise national regulations apply. The income threshholdÌý for Maltese citizens living in Malta wishing to bring their non-EU spouse or partner to Malta are 10.338Ìý !

As an EU national under your circumstances you can either register as looking for work with the ETC and register for residency , register for residency with a work contract or as economic self-sufficient ( either 23.300Ìý capital or 108.63 /week income). In all cases your wife's residence application depends on your own residency and you have to apply for her.

You have to show that you will not be a financial burden for the state of Malta and that you have adequate health insurance (coverage) for both of you.

You should and have to a register yourself and apply for your wife immediatly as her visa will probably expire otherwise and that could cause difficulties as her legal status will be checked on application and if her visa has expired there will be a lot of head shaking at the Evans Building!

As an EU citizen, you have the right to live and work in Malta (subject to the conditions I mentioned above), and your non EU wife has the same rights, but her rights only come into force once you have taken up your rights, by applying for your eResidence card.
