A card renewal during unemployment & incapable to work.

maharaji1984

Hi all i am asking this question behalve of one of my friend.

  1. Having unemployement benefit since a year and now time to renawal of A card in a month.
  2. Holding unlimited WP.
  3. Recently got an accident and not possible to work following 3 -4 months.
  4. Asked financial support from OCMV.

Has anyone faced such a situation before ?

How likely RP will renew or rejected ?

Thanks for all inquries.

Something is not correct and missing in this story … u can’t have unemployments benefits with A card normally …

@ievgenfeldmann

Everything is in this topic correct unless  your statement is incorrect.

Unemployement benefits are applicable to all employees who met with conditions.

Isn’t card A residency valid based on employment? How can you have a valid card A without work for a year?

maharaji1984

@Elena Igor

  1. Holding unlimited WP.

RP based on unlimited WP.

Elena Igor

Unlimited work permit (card A) does not mean that you have permanent residency (card L.) This means that as card A holder you have your residency right based on employment, if you are unemployed for more than 90 days you lose your rights.

Noone here claim if there is a PR or not.

Question is simple.

As long as you hold an unlimited WP and valid work contract you are granted to have RP.

What if you are unable to work at least 3 months prior to RP expire and having unemployment benefit at least a year prior to accident.

Based on your comment which rights are loosing? If so why unemployment benefits exist?

Elena Igor

You did not say you had a valid work contract. You are saying you are unemployed, meaning you have no work contract. If you have a valid work, but are  on sick leave that is another story
