L card application was rejected because of my expat work permit

Dear All,

I have been working in Belgium for 6 years.

Last Oct, I submitted application for L card, they gave me ANNEX 16bis.

After 5 months, I went to communale, but the person told me my application was rejected because my work contract with Belgium company was a kind of expatriate agreement.

Can anybody give some advices? Can I apply for other kind card, like B card?

What kind of expatriate agreement. DId u pay social contribution this is what matters.

There is a remark (gedetacheerd) following my position, they told me this remark is the reason.


i started paying social Insurance since Jan 2022. but they still said this did not matter, no helpful.

Thanks, that is really depressing.

I will move to a Begiulm company this year, with new contract.

But does that mean i will have to wait for another 5 years?

Is all my previous 6 years of no use at all?

@lianmeng56 For permanent residence, See if you are eligible for a B card (I am unsure about it) but if that is the case, unfortunately, your PR will be based on when you are on a local contract.

I did submit application for B card, according suggestion from communale.

they asked me to send a letter for applying, looks very unofficial.

anyway, let it go, can not exprct too much.

Hi, Unfortunately this is the case.

When you were not working on a local contract you were not paying social security. Only since Jan 2022 with the new rule you started paying social security even when you are on a non local contract.

In any case you would need to pay the social security for atleast some years (every commune will give a different answer 1 or 3 or 5 years) to be eligible for a B or L card. Because once you have these cards you are infact a permanent resident of Belgium and no longer need a visa and you can also have all the benefits which a citizen of Belgium enjoys. (like unemployment benefits).


I had this situation when I applied for my L card.. Think B card would follow the same procedure...

Can you please let me know for Antwerp Commune ( asking since you are from Antwerp region) what would be the criteria in terms of years of payment of Social Security. I am closer to 5 years stay in Belgium and 1.5 years of Social Security with local contract.

Unfortunately the number can vary based on the person checking your application.

If you are lucky the 5 years stay in Belgium is sufficient, but sometimes they look closely for the days you paid social security and also the days you were linked to a health insurance fund.

Give it a try once you finish 5 years in Belgium and fingers crossed you will get it approved.



When I applied, I was informed about this website page and the statement below.


Important: Normally when checking eligibility for unlimited residence card national authorities do not count in residence in Belgium linked to the assignment on behalf of the foreign employer, however, in this case the discretionary decision will be made by the Belgian Federal Immigration office.

May I ask if you changed your job during the 6 years in Belgium when your L card was rejected last year?
