You need your document to be specific as it can be in its  choice of language.

Otherwise you will open up to all kinds of situations where the power of attorney party will trade under your name for spurious reasons.

The copy you just posted is very much a generic boilerplate.  It;s very open ended.  Not good at all.

Get someone who can speak and write in both languages, no need to be an attorney at this stage,, and then craft the Power of Attorney that meets your needs.  And don't be a CBA for Chrissakes! ( CBA = Cheap Bastard of America ).  Pay for it!!!

You need to convey to what extend you are granting power of attorney, and be as specific as to what type of interventions one can do in your behalf.

Then go to the Cartorio which under you were registered ( that's a free procedure ), and make sure the document is registered there as well,.    You might pay a nominal fee, but at the very least, you covered  your arse.

Gheez, wheez. You guys take the cake!

@dyantyi28 In Brazil you cannot grant a general POA like you can in other countries - it has to be very specific and detail EXACTLY what can be done.

There are also several types of POA depending the purpose you are granting it. So you need to get advice.

Actually, I did one, a full and complete power of attorney over my health care, death, cars, apartments, rental contracts, bank accounts, retirement, etc. all of it.

@rraypo You did exactly what I said - specify what it is for. In other countries it is not necessary to do this, you can grant a general POA that covers most things...

It was easy. I did have to have a legal translator. My total cost was about R$800

I do know that a POA for the PF must be a public POA (needs to be done in a Brazilian notary office), you must take the original and they will keep it.

Personally I would only go in person as there are many slip-ups that could occur (eg my RNE had my wrong date of birth by 2 years), and I would include as much specific personal detail as you can, including dates of birth, CPFs, etc, etc.

This is only my advice as I did not use a POA 16 years agao when I got mine, so others may have better advice.

Exactly, and it was the cartório, (Brazilian notary office) that required me to have a legal translator, despite my having Residency. Personally, I would not attempt this without going in person to their office. It took me two appointments with the cartório and not every office would do this, not just walk-in times either, and the office only had two people to deal with this. The other POAs I have done were to just sell buy/selling a car, to pick up my CRNM, control a property etc. they were much easier, but even so, this was easy and I did not mind having the translator looking after my interests.

A legal translator, and R$ 800 bought you future insurance. That is the right way to go about it.

The editing specifics need not to be from a template. For as long as they convey your legal stipulations in a clear and concise manner.  So write yours in English, and then fish your pocket for a certified translation.

" a POA for the PF must be a public POA (needs to be done in a Brazilian notary office),"

That is correct.  |I needs to be registered to have legal value, and full recourse. So the Cartorio Rubber Stamping is key in making it legit.

Sorry, this is Brazil. In Rome, you do as the Romans do.
