I'm a Indian national working in Dubai. My wife will come to Dubai and apply to the residence permit as a housewife. she is having hep b carrier. Would she be denied the permit?

Nurianadia

I need help....in january 2011 me and my fiance we did the pre-marriage test on a gov. clinic and they told me i am hepatitis B positive. The doctor didnt want to talk to me about this pb...only with my fiancee because he wanted to convince him not to marry me:(. I cant believe that this can happen in Dubai everyone makes his own law there. He didnt gave us the certificate and treat us bad.

If its someone who can help me with anything i would be so appreciate. Maybe a hospital name a good one where someone can understand us..

Thank u

Hi mpcute07

First of all congrats for clearing your ban . Yes I see that you cant disclose the contacts of travel agent contact , however could you please help us in knowing from the travel agent person that what the immigration personnel is going to do with the others application papers , what makes immigration department to take so long to clear the ban .

If you could help us in knowing this information from the travel agent person , we will be very thankful to you .  May God bless you.

Thanks

Hi All

Quick Facts and a question.

Am a resident in DXB, for more than 2 years. Brought my family in 2009, couldnt get visa stamped in wife's passport due to Hep B. She flew back to home country after cancellation. I got her entry permit again last month and I called her again in UAE, got the entry paper and now my wife is with me. Now i need to get her medical test and get her residency visa stamped in her passport.

Question is:

Will she get a residency visa on my sponsorship, even though with Hep B as i heard the restriction for Hep B is lifted now. Am I correct in assuming that?

jai1

Hi dxb expat

Yes you are abosuletly correct she will get the residency permit , you go ahead with her medical test .

Congrats in advance

Hi Jai1,

Thanks.

I am very sorry that I can't contribute a clear instruction for clearing a ban. I paid that travel agency and the manager is a pakistan. He is not elaborating the details. He's the one who spoke with immigration in Dubai and who sent my docs to Abu dhabi. It takes a almost 3 months when my paper came out from abudhabi as he says general lifting of the ban should be done in the abudhabi as the system in DUbai is different. He doesn't mention how the paper was process into abudhabi.

But one of my friend check with jaffliya immigration, in the black list section the man said that they are clearing the ban but employment visa should be applied and not visit visa.

HI guys,

I would like to seek advice with Filipinos here. I know for a certain that new expatriates will be granted residency visa even positive with hepa b (except with the six categories). My employer told me so thats why they re-hire me.

My question is how to get out of the country legally. I went to POEA and I do have to undergo medical examination which involves hepatitis B. I will be labelled unfit to work for sure since I have this disease since 2004. Is there anybody here who had the same case?

Thanks in advance.

dontstop

@ stick 2

i have done my medical and they remarked my medical cert. 'UNFIT TO WORK" due to reactive HBsAg, accdg to them because this is the law in UAE. Now my employer told me that they will still hire me. POEA asked for a waiver from the employer, written there ...."even unfit to work due to hepatitis b"....the company will liable.....

Today, I have send the waiver to my employer for them to sign, but upon seeing the phrase "Unfit to Work" they paused and said they will send their PRO to Medical Fitness Center in Dubai to ask about it.

I just hope that I will not miss this opportunity to go back to Dubai. Anyway I am Engineer.

Thanks mpcute 07

However if you cant disclose the full details , your reply has cleared some of the enquiries . Thanks for the same . If you get any information pls dont forget to share with us .

Good Luck

Dear dontstop,

Is the law change again?

Please let me know, as for as I remember, heb b carriers are allowed to get visa except those 6 categories.

i dont know, As you mention that you are engineer then why they refused your case

can you please post the detail and the centre where you gone for this medical test.

thanks

Sias

himpcute07,

You mentioned that your friend had checked in Al Jaffliyah about lifting the ban does this mean that they will lift only the ban if you will reapply for residency visa?

for those who have latest info about the issue of ban lifting please share your ideas here just so worried i ma face the same situation now as my friend is gong to jaffliyah to forward m documents and it is sad to know that the immigration people will just keep you hanging with their decision when infact it is approved by the health authority, please share you thoughts.

Hello to all,

After reading posts regarding Hep B is no longer problem to get residency except 6 categories, my company wanted me to work in Abu Dhabi. Despite forum posts their PRO says they are still testing everyone in Abu Dhabi for Hep B. And if positive I will get permanent ban...
I am applying for first time for residency, not renewal.

Could someone tell me shall I go forward and take the medical test ?

This is really important, please help.

stick2

@ dontstop.

Thanks for the response.

Is that waiver will come from POEA? do they have a particular form for it? I have asked my employer for a letter signed and sealed by the company. Written that Hepatitis B will not be tested in Dubai for my particular category. and they are willing to hire me given the said condition. Any company will hesitate to sign anything that is written "will be liable"" in it. There is a private medical card in the contract. Will that suffice? I know this could happen (thanks to this blog) so I already asked my employer for a signed and sealed letter regarding this.

Now it is getting more tough... They have already clause in their form that the company will be liable for death, disease, or anything that would happen to the employee. Why are they so strict about this.

Anyway. Thanks dontstop for the information. I hope that your company will sign the said waiver.

HI Everyone,

A very devastating news i got from a friend of mine in Dubai who process my ban, she went to the immigration dept. in Jaffliyah to submit the documents and she met this person YOUSEF AL MARRI-assistant director of RESEDENCE NATURALIZATION & ADMINISTRATION but this fellow in the immigration refused to accept my documents and my friend even told him about the new rules why he cant accept the documents but the guy just didnt say anything without even telling why he cant accept the documents. So my friend then called the person who issued her the letter from Al Muhaisnah Ms. Iman but miss iman said maybe i still have any other issue besides that hepatitis will all i could say i never have history of having done troubles in dubai or so whatever or any bank credits that should be used as ground for banning except that what i know is that in my cancellation paper the reason why i cant be granted with residency visa is due to HEALTH REASON which i found out that becuase i have Hepatitis B and i have tested many times in the public clinic and private clinic in dubai and here in philippines that is true i have that. But i couldn't really understand why they publish such news way back in August of 2010 that they changes the rules and they can clear the ban if the person can provide a letter coming from the clinic where she or he failed and all of the sudden i must face this scenario of no explanation coming from the immigration why they cant accept the letter from the health autorities this made me think now if they are actually serious about this clearing the ban issue or it is only for a show that they have to publicize it in the newpapers. And my friend told me also that Ms. Iman from the clinic only advise her that on their side what they can do is to issue that letter and to them also the immigration side is the toughest becuase they dont have the a ssurance of removing the ban. So it only means that the rules that they are actually amended is pointless.I just want to really appeal averyone here of who we can speak in immigration for my documents be submitted or be heard at least i would really appreciate. Or even who we can talk in the immigration about the whole issue.I would really appreciate that.

Thanks and regards.

for info.. i have done my test in manila at two poea accredited centers. both remarked me 'unfit to work'. the 1st is due to reactive hbsag. the second required hbeag, but unfortunately it is still reactive.

i believe if i will be tested in uae now, there is a big chance for me to get the visa because im not in the 6 category. the problem is local testing centers in manila is more strict than uae. they are not yet changing the rule maybe its because they are not yet adviced of the new uae rule(if there is)

the only chance i have now is my employer to sign the waiver.
i will know their decision today.

@ stick2;
yes the waiver is from poea, that seems freaky and intimidating for employers...

This is exactly what I am asking for....

my employer said uae will stamp visa , if,
u r non-infectious carrier. i am not in uae yet. they just base on the the result on my test in manila.

unfortunately, i have missed a good package job..

for those who are in the uae already, i think you have a chance to pass the test.

God bless to us...

Sorry but I don't think there no such thing as "non-infectious" carrier regarding Hep B!!! If the new rule is being applied, you should get the residency. But as I see the posts in this forum, results are not the same for everyone...

stick2

@dontstop

I believe that your PRO (if he is the one who brought you the news) did not base the decision whether your are infectious or not. Because you will not be tested in Dubai in the first place. I think they just did not want to sign the waiver. Well based on the description you have on the content, no employer will ever sign that waiver.

I maybe wrong but this is how I see it. I know I will encounter this next week after my medical. I have to prepare myself.

Did your employer finalized it to you already?

Good luck to all of us.

nmansooralikhan

Hello to All

Anybody bring your wife with "hep b" and get the residency stamp from the immigration? Kindly give me correct details for that. Pls help me. That 6 Cat. are true or not? and new rule are implemented? I'm very confuse.

Thanks

yes you are right about the waiver.

second is the PRO report to the company is not clear/official. the pro was told, in the uae test center, that, "it is not sure that tha visa will be issued because of 'not fit to work'"

so the company avoid to take risk in spending for plane ticket and further...

i have spent more or less Php10K...

yes they have finalized it. they have asked me to send back the employment visa.

i don't know if they(POEA & Employer) handled my case appropriately.
but i know i am still in my best shape to work....

Hi everyone,

I just want to check for the ban issue that the possibility of clearing the ban is if you manage to get a new sponsor? How true is this and what is the assurance that if in case you get a new employer to be your sponsor that the immigration people in UAE will not put your new employer in hard procedure for the application of your visa since the immigration can view it from their system that you had banned.I hope some could share their stories here i just needed to clarify this story i heard about lifting the ban.

Thank u.

Hi Manmadan,

If you are coming to UAE for the first time, then I hope there would not be any issues in your case, as your professional is not one among 6 professions.

Hi Manmada,

If you closing read all the postings here, it states that the rule is implemented and that can be clearly witnessed from DHA, as they are issuing a letter to DNRD that they do not have any concern in issuing residence visa for affected people. Please follow with new forum created "newvisa/HBV" to get more information.
