TIE - out of Spain for 11 months.

Dazbear

We have lived in Spain for 7 years and have permanent residency (TIE Art 50).

We will be out of Spain for more than 183 days this year and will be tax resident in the UK. The gester says we have to remove ourselves out of the Spanish Tax System for the year.

2025 we will be back in Spain and tax residents here.

Will this affect our TIE? We have has yes, no and maybe from the authorities :o/

Thanks

Hello Dazbear,

Given your situation, it is essential to consult with tax and legal professionals who is specialise in cross-border taxation and residency matters. They can provide personalised advice based on your specific circumstances and ensure compliance with both Spanish and UK tax laws.

You can check for some professionals in our Spain business directoryif needed.

Hi

We have received an answer from the British Embassy and the Spanish Foreigners Office. I was most impressed with the speed of their response.

They both say the same....

Because our Permanent Residency is under the Brexit Withdrawal Agreement (Article 50) we can live outside of Spain for 5 years without it effecting our TIE/Long Term Residency.

Our Fiscal position (tax) has nothing to do with Residencia.

Thanks
