Get certificate of legal capacity without going back to Germany

Can anyone help where to get certificate of legal capacity without going back to Germany nor going to the embassy? We have been having trouble with the marriage application

The certificate of legal capacity to marry (Ehefähigkeitszeugnis) has to be issued by the family registry of the current or (if currently abroad) last residence in Germany. You have to contact that authority (not the embassy), there is no way around it. However, I assume you can apply for it by mail, so you might not need to travel - but better ask them for the procedure and requirements!

@Cheryl  I live in the Philippines, I ask some kind of alternatives if there is any to help my German boyfriend acquire a legal capacity certificate because he has no certificate of no impediment to marriage so he could not get the legal capacity from the German embassy. He couldn't go back to Germany because he doesn't have a permanent residence there that's why he traveled to the Philippines to stay. He used to rent in Germany but he lost his job so he couldn't afford to live there anymore.

Why can't your partner, being German, speaking the language and used to the way German officials work, figure this out himself? As I said, contacting the embassy/consulate and probably also the local family registry in his former home town will definitely be necessary. Only they can tell him what to do and whether a personalvisit is needed.

Document needs to be issued locally in Germany but I think one can get assistance through the German embassy or consulate. It is not the standard situation but  a few million Germans live abroad. Officials deal with this regularly. It would be a lot of cost and effort to have to fly back to Germany to do this but it is not that one can't. A German doesn't have to have a residence to visit Germany.

@donna02tolentino Hi, I don’t believe you are being told the truth. Is your boyfriend German? Does he have a German passport? If yes, then why not get married in the Philippines? First you will both need to verify that you are not married to other persons. After marriage, bring certificate to the German embassy & have it verified. Then you can apply for spouse visa, you will need to submit all the required information that you will find on visa site. (Including visa application payment) You will probably need to wait for an answer for 3-6 months. Never heard of a German national being refused re-entry to his homeland. He may left to get away from some commitments & that’s why he is saying he can’t go back! Best of luck!
