Laid off from Job and new SP situation

Hi,

I was terminated from my Job on Jan 20th,2021 and my notice period ended on March 2nd.

I have applied for unemployment benefits and the ONEM has asked for Annex 51 document (that tells me to leave the country after three months of job end date). I asked the commune for the document and they said they didn't receive any such document from Ministry.

In the meantime I got a job offer in April who initiated my new Single Permit during the first week of May. I am still waiting for the approval and haven't received the Annex 49 or Annex 46.

Now the question is, on June 2nd, I will finish 3 months without a job.

Would I be asked to leave the country or I can stay as my new SP is filed and I am waiting for decision?

I still have a valid Resident Permit that is valid till April'2023 and I am also eligible for 5 year PR card which I have applied in January and should get it end of June.

Could any of you guide me with this and what I need to do in case I don't receive the new SP approval before June 2nd? And also should I be talking to my commune asking for the status of Annex 51 or leave it for now?

I assume its jan21 ? Did you receive first WP approval ? That you should normally receive before Anex46.

I haven't received the first approval yet. I was laid off in Jan,2021 but the notice period ended on March 2nd.

Hi,

Within 3 months, either you have to start working or you should file for a new Single Permit.
Since you have already filed it within the 3 months, no need to worry about it and you can stay.

On the other note,though your RP is valid until 2023 only if you continue to work with the employer. Once your employment ceases, ibiz sends a note to you and commune about the last day of stay.

You have not received that note yet, may be your previous employer has not informed the ibiz on revoking the SP

I haven't received any letter yet from commune. Have asked them about it as ONEM is also expecting the document.  I am also eligible for PR as I have been here for more than 7 years. I couldn't apply last year as I was stuck in India when I went for vacation.

Would this lay off impact my PR approval?
