Permanent residence - conditions for the eligibility

Prates86

Hi,

I am writing this topic to get insights specially from those who have already experienced the process.

I am about to complete 5 years living in Belgium, more specifically in Brussels.

Now I am doing a search for the information on the application for the permanent residence card.

I found 2 sources that, if I am understanding correctly, apparently saying different things about the the same subject, I am wanted to understand what should be followed:

1 - First I see this one

which states that 5 years of living in Belgium are required for the eligibility.

2 - I also found this one:

which states that, given my conditions (spouse and kinds living legally with me), only 2 years of living and working in Belgium are required.

Question for those from experience have passed the process:

  • Did you follow conditions mentioned in point 1?
  • Did you follow conditions in point 2?
  • What is the starting date considered for counting the period? Is it that one from the commune registration or the first social security payment date?
  • What is the type of the card?

I hope this discussion can help me and many other with the same doubts.

Thanks in advance!

I guess option 1 is the normal way to go. The two year option might be if your spouse already held a belgian nationality. ( the link seems to be still under review hence cant really tell) but thats what I know so far.

Your period starts from the date of registration to commune which will be mentioned in your card and now you should be getting a B card which is the permanent residency card and as soon as you get this card you can apply for citizenship right away (but ofcourse you would have completed the integration programme) if you were not working

link 2 is about work permit, it is different from residence permit, it is for those people who did not reach 5 years but want to be flex and change employees, they still get card 1-year A but illimite (which means illimited work permit).

You need to follow link 1.

5 years is the minimum for everyone already. If you look closer to your 2nd link, it is for the Work permit (not Residence permit, hence, not Single Permit)!

@peterjohn1104  The second link is actually for an unlimited single permit (i.e.,  unlimited work permit that requires a new resident permit).

The first link is for an unlimited residency permit, which includes a right to work.
