Unlimited work permit renewal without work contract

rhiarhi

Hello all, I have a strange situation here: in two months I will need to renew my unlimited work permit but the problem is I was not working due to a long-term illness so I do not have a contract that I can provide nor the payslips of the last 3 months ... what am I supposed to do in such case?

Hi, By an Unlimited work permit do you mean an A card or do you already possess a B or L card?

if its is an A card and you don't have a work contract, then indeed would be difficult.

If its a B or L, then perhaps this would not be an issue.

Better to check with your cityhall on this situation beforehand.

@rhiarhi Given you have given limited informations about your situation: it is hard to tell exactly what rights you have.

However, in any case, for anyone to qualify for unlimited single permit ( I guess it is what you implied by unlimited work permit), they must have lived in Belgium and worked for a number of year; which means that you have certainly lived in Belgium form more than 5 years and worked for more than 3 years. if so is the case, why would not you go for L card instead of renewing the single permit ( I suppose that you have the rights for it, if my guesses above are correct)

@BMM996210 it is card A :(

@Mu Jaycee I hold a card A with an unlimited work permit, I have lived in Belgium for 4 years and I got the unlimited work permit last year after 3 years, what are the requirements for L card?

Hi,

So you have an unlimited permit which is linked to your employer.

Are you still employed with them?. if yes they will help you get it renewed.

if you are no longer employed, then your situation takes a different turn.

Were you working on a local contract? if yes and if you have worked for 4 years perhaps this can help you.

For an L or B card you need to be living and working in Belgium for 5 years (including paying social security).

when you have an unlimited work permit (approved by your region of residence) why do you have to renew the work permit?

because you worked for 4 years continuously in the last 5 five years by the time you first applied for your unlimited work permit.

if you have got an approval from your region and simultaneously from the immigration for stay , you must have got permanent residency (B card / L card)

in this case you need not to renew your card until the validity of B card expires and this card allows you to work for any employer without work permit or restriction.

after your unlimited work permit approved by region, did you not get your approval from immigration ?

@rhiarhi Does the unlimited work permit expire after one year ? I think that it has to be renewed every 5 years.  And it is not linked to a specific employer

rhiarhi

@BMM996210 unlimited work permit is not linked to my employer and I cannot apply for a B card because I didn't finish 5 years :( I can get another job but I don't have much time to search ... because my residence will expire and to renew it I need 3 months payslips ... which I don't have because I was not working

rhiarhi

@karthick_ actually not, I got an unlimited work permit with A card after working for 3 years. The residence card is valid for 1 year with unlimited work permit and to renew it they require 3 months payslips

rhiarhi

@Mu Jaycee you're mixing unlimited residency with unlimited work permit, with unlimited work permit you only get 1 year residency if you have A card

rhiarhi

@BMM996210 btw thanks for the link I didn't know that they consider sick leave as work and it solves the problem

BMM996210

@rhiarhi Hi,

Hope it solves your situation.

Also thank you for giving me an insight that an A card is not always linked to an employer.
