Authorization Contact - Property

Would like seek some advise here.

My father and I each both bought an apartment here in Saigon. As my father is of age now, he would like to authorize me to manage his apartment. Property management company (PMC) told me the necessary documents to prepare, which we had done (including going to the Vietnam embassy here to legalized the documents).

Now PMC told me developer said cannot do authorization for our apartments, other projects that this same developer build is possible, but just not this specify project that I bought from them. PMC further said that in future if we need to sell our units, might need developer help.

I really don't understand why. Thought after official handover and full payment, it is up the the buyer to decide what they want to do. Why is the developer still in the picture?

Am I missing something here? Lastly, could someone arrange a good lawyer in Saigon to me please? My father and I will be there next month to do this authorization thinggy, so we hope to settle before we go.

When you walked out of the terminal at Tan Son Nhat did you notice that you were in in a different country than the one you left?

@Wxx3 obviously I know it is a different country that is why I am posing this question here. As since it is a different country so I might not have a comprehensive knowledge of some issues. If I would have know the answer to my question, I would not have posted here for advise in the first place.

Have you received the pink book for your apartment?

It sounds like the developer doesn't have full title of the property. The bank is most probably owed money, therefore, the titles for each apartment wont be released. Many buildings in VN have the same problem.

This forum is a wonderful place to find out where to buy peanut butter.
Why? Because it doesn't depend on the local culture, beliefs, rules or bureaucracy.

There are a few on this forum who speak Vietnamese and really understand the culture. They have some wonderful explanations of all sorts of strange phenomena.

But questions that deal with how to do something in dealing with the local bureaucracy is pointless, because every experience is unique. What works for one person, won't work for someone else.
It's not even an expat thing, it's a Vietnamese thing.

I love Vietnam, both the people and the place. But it' not a place for consistency.

If you see a good Vietnamese lawyer, I'm sure he/she will tell you the same thing.

As you and your father are foreigners, you likely don't have "legal title" to your apartment yet because the state has not issued the pink book to you. The pink book is equivalent to a property title document.

Currently, almost all foreign homeowners do not have a pink book / title because of red tape with the government (involving military, etc.). Until they have this pink book, foreigners only have ownership on paper/contract with the developer. Therefore, if foreigners want to "sell" their property before the pink is issued, they simply transfer their rights under the contract. This needs approval from the developer because they are on the contract as well.

In any case, you shouldn't be making full payment. Until pink book is issued, you are legally entitled to withhold 5% of the purchase price. Developer cannot take this by law. If they did, they're probably doing shoddy things.

Regardless, authorisations in Vietnam between individuals should be done at a notary public. Feel free to PM if you need further info
