british citizensh for son and husband

Julia McHugh

Hi all

I'm hoping someone can answer my questions as acurately as possible. For the last year or so my husband and i hav e been searchiing the internet for some straight answers.

Here's our story:

In May 2011 my husband and i met online. In Aug of that year i came to india to meet him. In Nov 2011, we got married. Since then we have been living in India.

On the 14 Jan  2014 we had our son. We both been trying to find out what if any assistance is given by the british government in getting me and my family to the UK. We thought that it would be easy as i am a British citizen. We simply cannot afford the astronomical fees involved in getting a visa for my husband and now we have a son that we want to raise in the UK.

We are currently living in Kollur, south India. There is absolutley no future here for my son or my husband.

The other path we could take is to go and live in South Africa. I have PR there, but again we are finding it difficult to get answers regarding my son's exit from India.

If anybody can shed some light on these issues, i would forever be grateful.

Cheers
Julia

If you hold a dual passport. You were born and raised in South Africa. Maybe you have a Brit and SA passports. There should not be any issue until you have a dual passport. And your baby is eligible for dual nationally (Indian/South Africa or British) depends on the parents current passport nationality. Approach the near by embassy

Was your son born in India or the UK? You haven't mentioned that.
If your son was born in India, he becomes an Indian citizen by birth and you will have to take him to UK as a dependent where he will have to spend a few years before he can apply for UK citizenship as a naturalized citizen. He will have to relinquish his Indian passport then.
The UK government does not provide any assistance to its citizens in this regard.
Your husband will have to accompany you to the UK on a dependent visa and he must spend a few years there before he becomes a naturalized citizen. You will have to prove your union in marriage certified from the Indian Ministry of External Affairs from a consular office here and produce the documents before the Home department in the UK.
Once it is approved, your husband will receive a dependent visa which can be converted to a PR later on.
Hope that addresses your concerns!
