Important: Non Citizens (Employment Restriction) Act amended

In regards to the communique from the Ministry of Labour,
Important information which was not communicated:
Foreign spouses of Mauritian citizens married prior to the 8th March 2019 are permanently exempted from having to have a work permit to work in Mauritius.
Even if the foreign spouses were to change employer or type of work, the exemption still applies.
Got this information from the Ministry of Labour a few minutes ago by calling the phone number provided by the communique itself, that is 405 0132.


Do not bother calling 207 2700, 207 2711, 207 2712 or 207 2714, numbers listed on the Ministry of Labour's website. As soon as you tell them you would like some clarifications on the Non-Citizens (Employment Restrictions) Act or the Non-Citizens (Employment Restrictions) Exemptions Regulations they dump you in a waiting lobby to be tortured by a repetitive robotic voice slamming "Hold the line .. Hold the line" into your ear until you are saved by either them literally hanging up on you after 3 long minutes or you running out of credit, basically meaning you just paid to be mistreated.

or is there a mistake /typo?

Apologies - it is indeed a typo, it should read 'foreign spouse married to a citizen'...

I am non citizen married to a Mauritian for almost 30 years i.e. well before 8th March 2019!!  However, I started work in Mauritius AFTER 8th March 2019.  So do I need a permit or not?  My employer is saying I do, but based on the first paragraph it seems the date of marriage is the important thing here.  I am really confused.  How is this to be interpreted?

From what I'm seeing here and from what I have read on the news, you are exempted from this work permit.
Your employer saying you need a WP might be due to some confusion on his part but I can't be 100% sure. I can only hope.
Let's see what the others well versed on this thread reply to your query.

How long have you been a resident on the island on the spouse permit?
Recently?
That may be the confusion on the part of your employer

Yes, recently - we have been in Mauritius for a few months.  Applied for residence permit in January and was told I could work.   Started work after 8th March but before residence permit came through.  Just got residence permit.  I think it is best my employer applies for work permit to be on safe side....but  the paragraph about being married before 8th March seems clear.

Hi Shirl1 - if you have been (civilly) married to a Mauritian Citizen before 08 March 2019, whether you were working or not prior to 08 March 2019, you are exempt from the requirement of the work permit.
