Foreign investment tax (or whatever it is called)

I am about to transfer a big sum of money from Europe into Mauritius for the purchase of real estate. The real estate is for my own private use, so not for resell, not for rental. So it is not an "investment", just simply for my own private use.


I heard that incoming money into Mauritius  from abroad is taxable at 5%? The money I will transfer is in € but I can also transfer directly in Rs. I will transfer the money either directly to the notary or into my Mauritius bank account.


  1. Is it true that you need to pay a tax (5%?) on incoming money from abroad?
  2. Do you need to declare such transaction with some Mauritius governmental body?
  3. Does it make a difference if you are a citizen or a non-citizen?
  4. Does it make a difference if I transfer this money directly to the notary or into my Mauritius bank account?

I think you may be referring to this:

Land transfer tax

Per the Land (Duties and Taxes) Act, land transfer tax is levied on the transfer of land and is payable by the trans­feror at the rate of 5%.


Land transfer tax is also payable at the above rates by the transferor upon transfer of the shares of a company owning immovable properties, based on the value of shares or property, whichever is the lower.


The following transactions are not subject to land transfer duty (non-exhaustive list):


A transfer of immovable property from ascendant to descendant (or vice versa).

A transfer of immovable property or shares between companies forming part of a group of companies, as defined in the Companies Act 2001.

A transfer of immovable property where such transfer takes place between companies having the same shareholders for the sole purpose of merging.


My limited understanding is that, depending on what you are purchasing, e.g. from the developer, this may already be reflected in the agreed price.
